1. Purpose and seller
These terms govern sales made on this site by Jérôme Dupont, sole trader operating under the trading name JD Creative Studio, SIRET 107 007 874 000 12, whose full details appear in the legal notice.
Placing an order implies unreserved acceptance of these terms.
2. Products
The studio offers two kinds of product:
- music recordings delivered as downloadable digital files;
- textile items printed on demand and shipped.
Graphic design and video editing services are not sold online: they are subject to a prior quotation.
3. Prices and payment
Prices are shown in euros. Under article 293 B of the French General Tax Code, VAT does not apply: the prices displayed are therefore net.
For physical items, shipping costs are calculated at the time of ordering, based on the address given, and shown before any payment.
Payment is made by bank card through Stripe. The studio never has access to the buyer's card details.
4. Delivery of music files
Once payment is confirmed, download links are sent by email and shown on the confirmation page. These links are valid for 30 days and limited to ten downloads.
It is up to the buyer to save the files during that period. After that, a reactivation can be requested from the studio.
5. Delivery of physical items
Items are printed on demand, then shipped within mainland France and the European Union. Allow a few days of production before dispatch, plus the carrier's own delivery time.
The times announced are indicative. In the event of a significant delay, the buyer may request the cancellation of the order and a refund.
6. Right of withdrawal
Physical items: in accordance with article L.221-18 of the French Consumer Code, the buyer has 14 days from receipt to withdraw, without having to give a reason. The item must be returned in its original condition; return postage remains at the buyer's expense. The refund is made within 14 days of the return being received.
Music files: under article L.221-28 13° of the same code, the buyer expressly waives the right of withdrawal as soon as the download has begun, and acknowledges this when ordering. As long as no file has been downloaded, withdrawal remains possible.
7. Warranties
Items carry the legal warranty of conformity (art. L.217-4 and following of the French Consumer Code) and the warranty against hidden defects (art. 1641 of the French Civil Code).
An item received damaged or not as described should be reported to the studio with photographs: it will be replaced or refunded, at no cost.
8. Intellectual property
Buying a music file grants a strictly personal right of use. It authorises neither resale, nor public broadcast, nor inclusion in a third-party work without the author's prior written agreement.
9. Complaints and disputes
Any complaint may be addressed to the studio at j.dupont77650@gmail.com.
Failing an amicable solution, the consumer may turn free of charge to a consumer mediator, or refer the matter to the European online dispute resolution platform at ec.europa.eu/consumers/odr.
French law applies.
